My name is Pieter van Onzenoort. I give advice on all civil law aspects of the transfer of family businesses and family assets to next generations. My advice is aimed at arrangements that ensure good family relations can be maintained.
I give advice on prenuptial agreements, testaments, general powers of attorney, gifts and the settlement of estates.
I advise on the legal structure of the family business and/or family assets, including the governance aspects thereof, with a particular focus on the transfer of the business or assets to next generations.
The focal point of my advice is that all arrangements interconnect and strengthen each other, aiming at ensuring continuity of the family business and the family assets. The main goal is to foster good family relations. I take into account the current and future tax aspects of the arrangements, but this is not my primary focus.
You are contemplating how to transfer or bequeath your assets to your children, possibly grandchildren and/or others. You are not aware of all the options and which are prudent. You are taking into account the possibility that at some point in the future, you will no longer be able to make decisions and someone else will have to look after your interests. You want to consult with an independent advisor to develop your thoughts and map out your policy.
Your family has a family business and you want to continue this business within the family. You are not aware of all the aspects involved and how and when best to start the transfer. Your goal is to ensure continuity of the family business. It is important to you that there are clear rules about the management and supervision of the company, specifically when it comes to the transfer of management to the next generation. You need independent advice and an advisor to guide your family through this process.
You have been appointed as executor of an estate. The estate is complex owing to its structure, (family)relations and/or international aspects. You need legal guidance on your duties as executor.
You have been appointed heir of an estate. You do not have, or have not been given, a clear picture of your legal position and are in need of legal advice.
